Flag-burning horizon

Two flag-desecration amendments were introduced in 2009 in the 111th Congress.

House Joint Resolution 8, sponsored by Rep. Jo Ann Emerson, R-Mo., and
introduced on Jan. 7, 2009, would give Congress and the states the power to make
flag desecration illegal and establish criminal penalties. It was referred to the House Judiciary Committee the
same day.

Senate Joint Resolution 15, sponsored by Sen. David Vitter, R-La., proposes “an amendment to the Constitution of the United States authorizing the Congress to prohibit the physical desecration of the flag of the United States.” It was introduced on May 6, 2009, and then referred to the Judiciary Committee.
