Autopsy photos private, 9th Circuit rules

The San Francisco Chronicle reports that the 9th U.S. Circuit Court of Appeals ruled yesterday that families have a constitutional right to keep loved ones’ autopsy photos private.

The appeals court further said family members can sue police or other public officials who release such pictures to the news media, though it gave immunity to the retired prosecutor who sent photos to the press in this case. The ruling was made on privacy and due-process grounds.
