8th Circuit backs Minn. Good News Club

The 8th U.S. Circuit Court of Appeals has ruled in favor of a religious club barred from a Minneapolis school district’s after-school program, Education Week reports.

A federal judge had refused the Good News Club’s request for a preliminary injunction allowing it to participate in the after-school program. But a three-judge panel of the 8th Circuit yesterday overturned that ruling, relying on the U.S. Supreme Court’s 2001 ruling in Good News Club v. Milford Central School and the 8th Circuit’s 1994 decision in Good News/Good Sports Club v. School District of the City of Ladue.

“This is a relatively uncontroversial case of viewpoint discrimination,” the panel said.
